The Miss America Foundation values your participation and support and is committed to protecting your privacy. We maintain strict donor information privacy policies and take great care to ensure that unauthorized persons do not access or compromise your information.

What Information We Collect

Our online registration forms, as well as our offline sign-up forms, contribution cards, or donor brochures require users to give us contact information that may include name, e-mail address, address, interests, and similar information.

How The Miss America Foundation Uses Your Information ONLINE

  • We will send you e-mails from the Miss America Foundation updating you on noteworthy developments or initiatives to help empower women through career resources and scholarships. If you do not wish to hear from us, simply use the unsubscribe link on these e-mails and/or contact us directly.
  • We will send thank you notes acknowledging your gifts and will provide receipts for your donations via email, if the original gift comes through our online system.
  • We will inform you about fundraising opportunities, organization news, and other activities of the Miss America Foundation.

How The Miss America Foundation Uses Your Information OFFLINE

  • We will send you hard copy mailings from the Miss America Foundation updating you on noteworthy developments or initiatives that support our mission. If you do not wish to hear from us, simply use the provided, postage paid envelope to send us a note, or call 808-230-3203 or email us.
  • We will send thank you notes acknowledging your gifts and will provide receipts for your donations.
  • We will inform you about fundraising opportunities, organization news, and other activities of the Miss America Foundation.

Donor Information Privacy

The Miss America Foundation does not trade, share, or sell your personal information to any organization or individual, nor do we send donor mailings on behalf of other organizations.

We will not divulge personal information to any other organization or individual other than that necessary to transact, fulfill, and or account for donations that you have authorized.

The Miss America Foundation does not share your information with telemarketing centers or use telephone marketing to solicit funds.

The Miss America Foundation will only use your phone number if we need to verify information or to thank you for your contribution, ask for your opinion, request your assistance, or invite you to a special event.

Security

Online:

All sensitive information provided to the Miss America Foundation online is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt or scramble data before you send it to us. We also protect account information by placing it on a secure portion of our site that is only accessible by certain qualified employees of the Miss America Foundation. Unfortunately, no data transmission over the Internet is 100 percent secure. While we strive to protect your information, we cannot guarantee or warrant the security of such information.

Offline:

Information received is processed and protected through a secure, online data system called Constant Contact and/or Salesforce. These programs are used by Development professionals across the country and is well regarded. Access to this system is accessible only by certain qualified employees of the Miss America Foundation. Prior to processing, all account information is protected by placing it in a double-locked safe within our office. This office and safe is only accessible by certain qualified employees of the Miss America Foundation.

Website Terms and Conditions of Use

This website is provided by The Miss America Foundation, Inc, (MAF).  By accessing this website (the “Site”), you are indicating your acknowledgment and acceptance of these Terms of Use (“TOU”). These Terms of Use are subject to change by MAF at any time in its discretion. This TOU constitutes a legally binding contract between the user (“you” or “your”), on the one hand, and The Miss America Foundation, Inc, suppliers, and providers, (collectively “we,” “us” or “our”), on the other hand. Please read this TOU carefully before using the Site or activating an account with us. By using the Site, you acknowledge that you have read this TOU, understand it and agree to be bound by its terms, conditions and guidelines, as we may amend from time to time by posting any revised TOU on the Site. Your use of this Site after such changes are implemented constitutes your acknowledgment and acceptance of the changes. Please consult these TOU regularly.

Violations

MAF may monitor use of this Site at all times to determine compliance with this TOU. Please also note that if we determine you have abused or violated the letter or intent of any of these terms, conditions or guidelines, or any applicable law, we may terminate or suspend your access to the Site and all related services, initiate an investigation, remove materials from our servers, issue a warning, block any prohibited activity, and take any other responsive action. You agree that all billing and registration information you provide on the Site will be accurate and complete. Your provision of inaccurate or incomplete information constitutes a material breach of this TOU.

Our use of your personal information collected on the Site is governed by the terms of the MAF Privacy Policy. The Privacy Policy sets forth our sole obligations with respect to user data and privacy.

This Site’s overall “look and feel” and the various MAF logos, service marks, trademarks, and other brand indicia found on the Site are the exclusive property of The Miss America Foundation, Inc., and may not be used without the express written permission of The Miss America Foundation. Furthermore, The Miss America Foundation, Inc., and/or its licensors own all right, title and interest in and to all content (and all compilations thereof) that appears on or is available through this Site and any other website owned, operated, or controlled by MAF, including without limitation all text, music, sounds, photographs, videos, images, illustrations, icons, graphics, headers, typefaces, data, inventory information, databases and software (collectively, the “Content”). The Content is protected by United States and international law. No right, title or ownership interest to any of the Content is assigned, conveyed, or otherwise transferred to you by your use of the Site. You may access and view the Content solely for personal, noncommercial purposes. Use of the Content except as expressly provided in this TOU may violate the intellectual property rights of MAF and/or its licensors.

Except as set forth in this paragraph, you may not copy, distribute, display, publicly perform, transmit, or broadcast the Content or use the Content to create derivative works or compilations without prior written consent from MAF. Applicable law may not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

This Site and all related services are provided on an “as-is” and “as available” basis and with all faults, and the entire risk as to satisfactory quality, performance, accuracy, and effort is with you. Applicable Law

The TOU is governed by and will be construed in accordance with the laws of the state of New Jersey as it is applied to contracts entered into by residents of the state of New Jersey.

Disputes

Any dispute relating in any way to your visit to this Site or any other website owned, operated or controlled by MAF or to products you purchase through this Site will be submitted to confidential arbitration in New Jersey. Notwithstanding the preceding sentence, to the extent you have in any manner violated or threatened to violate The Miss America Foundation, Inc.’s intellectual property rights, The Miss America Foundation, Inc., may seek injunctive or other appropriate relief in any state or federal court in the state of New Jersey, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this TOU shall be conducted by a single arbitrator under the rules then prevailing under the Commercial Arbitration Rules of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Policy for Claims of Infringement of Copyrighted Material

If you believe that material is posted on the Site in a manner that infringes your copyright, please notify us by providing the following information in writing to our Legal Department at the address listed below:

  1. A physical or electronic signature of the owner of the allegedly infringed copyright or such owner’s authorized representative.
